Terms of use

1. Scope and provider

These terms apply to the use of the Jourimo website and application. The provider and contracting party is:

Differing terms of a user do not become part of the contract unless we expressly agree to them.

2. What Jourimo is — and is not

Jourimo is a planning tool. It helps you put a round trip together, order stages and driving times, get suggestions and keep the plan.

Jourimo is not a tour operator, not a travel agent and not a travel agency. We sell no flights, stays, rental cars or other travel services, and we conclude no contracts on anyone else’s behalf. Where Jourimo shows a price or links to a booking site, that link leads away from our service. A contract comes about solely between you and the respective provider, on that provider’s terms and at that provider’s prices.

Combining several services in one travel plan expressly creates neither a package tour nor a linked travel arrangement within the meaning of §§ 651a ff. of the German Civil Code. Jourimo does not create or broker the booking and handles no payments for travel services.

3. Account

An account is required. You must be at least 16 years old. The details you give on registration must be correct, and your credentials must be kept confidential. Please tell us if you suspect unauthorised use.

There is no entitlement to an account being opened. One account per person is intended.

4. Prices

Jourimo is currently free to use in full; paid features are not yet switched on. Once they exist, their scope, price and term will be shown clearly before you commit, and these terms will be extended by the payment and withdrawal rules. No costs arise without an explicit order.

5. Your content

Travel plans, notes, ratings, write-ups and images you add remain yours. We claim no ownership of them.

So that we can display, store, back up and show your content at the visibility you choose, you grant us a non-exclusive, royalty-free right of use. It is limited to operating Jourimo and ends as soon as you delete the content or your account. If you make something public, the right also covers showing it to visitors who are not signed in, for as long as you leave it public.

You warrant that you hold the necessary rights. For images that means in particular: you took them yourself or are allowed to use them, and anyone depicted agrees to publication. We remove unlawful content; in serious or repeated cases we may block the account.

6. What is not allowed

• Automated extraction of the service or its interfaces unless we expressly allow it.
• Circumventing usage limits or security measures.
• Using someone else’s account or passing on your own credentials.
• Adding unlawful or offensive content, or content that infringes the rights of others.
• Anything that disrupts operation or harms others, including loading our data sources beyond normal use.

7. Availability and test phase

Jourimo is in a test phase. Features may change, appear or disappear, and interruptions can occur. We promise no particular level of availability.

We recommend keeping a copy of important plans. Under “Settings” you can download all your data as a file at any time, and every travel plan can be printed.

8. Prices, availability and suggestions

Flight and stay prices, availability, driving times, weather and place data come from third parties. They can be out of date, incomplete or wrong, and are never binding. What the respective provider shows during booking is what counts.

Jourimo marks at the value itself where it came from: fetched live, from a cache, estimated, or demo data. Suggestions are recommendations, not assurances. Whether a trip is feasible, safe and right for you is your decision; please check entry, health and safety requirements with the competent authorities.

9. Affiliate links

Some links lead to booking sites through affiliate programmes. If you book through one we may earn a commission; the price you pay does not change. Which results are shown, and in what order, does not depend on whether a commission is earned.

10. Term, termination, blocking

You can stop using Jourimo at any time and delete your account yourself under “Settings”. Deletion takes effect immediately and covers your trips and your profile.

We may block or terminate an account in the event of serious or repeated breaches of these terms, if operation is endangered, or if we are legally obliged to. When we block an account we give the reason as far as we are able to. If the service is discontinued altogether we will announce it with reasonable notice so that you can export your data.

11. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and to the extent of any guarantee given.

For ordinary negligence we are liable only for breach of a material contractual obligation — one whose fulfilment makes proper performance possible in the first place and on whose observance you may regularly rely. In that case liability is limited to the foreseeable damage typical for this kind of contract. Liability is otherwise excluded.

Third-party performance is not covered: for bookings, flights, stays and other travel services the respective provider alone is liable. For damage arising from travel decisions based on non-binding data or suggestions we are liable only under the paragraphs above.

12. Changes to these terms

We may change these terms when the service, the law or case law changes. We will give reasonable notice of material changes before they take effect. If you do not object and keep using Jourimo, the new version applies; otherwise you can delete your account.

13. Final provisions

German law applies. If you are a consumer habitually resident in another country, the mandatory consumer protection rules of that country remain unaffected.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

Should a provision be invalid, the rest of the contract remains in force.
